These Membership Terms and Conditions (Terms) apply to your purchase and use of a 2K Betting Premium subscription. By purchasing or using a subscription, you agree to these Terms and acknowledge the Privacy Policy made available to you.

 

1. Nature of the Service 2K Betting Premium is a subscription sports-analysis service. We provide sports analysis, statistical information, market insights, opinions and suggested selections for informational and entertainment purposes. 2K Betting Premium is not a wagering operator, bookmaker or gambling account provider. We do not accept, place, transmit or facilitate bets; provide wagering accounts; hold customer wagering funds; or enable subscribers to place wagers through our website, membership service or private member channels. Any decision to place a wager is made independently by the subscriber through a third-party wagering provider. Content supplied by 2K Betting Premium does not constitute financial, investment or personalised financial advice.

 

2. No Guarantee of Results Sporting events and wagering markets involve uncertainty. No selection, analysis, statistic, opinion, market assessment or other information supplied by 2K Betting Premium guarantees any sporting result, wagering outcome, profit or financial return. Past performance, previous results and historical outcomes are not guarantees or reliable indicators of future results. A reference to a previous successful selection or result must not be understood as a representation that a similar future result will occur.

 

3. Subscriber Responsibility You remain responsible for deciding whether and how to use information supplied through 2K Betting Premium. If you choose to place a wager, that decision is made independently by you and through a third-party wagering provider. You are responsible for considering your own circumstances, financial position and risk tolerance. You should never wager more than you can afford to lose and should not rely on wagering as a source of guaranteed income.

 

4. Age Requirement 2K Betting Premium is an 18+ service. You must be at least 18 years old to purchase a subscription, access paid member content or join a 2K Betting Premium member messaging group. By subscribing, you confirm that you are 18 years of age or older. We may take reasonable steps to verify age where required by law or where reasonably necessary. You must not provide paid member content or access credentials to anyone under 18.

 

5. Subscription Plans and Inclusions We may offer different subscription plans. The current price, billing frequency and material inclusions of each plan will be displayed before purchase. Plan inclusions may include curated selections, sports analysis, member-only updates, market information, alerts and access to private member channels. Unless expressly stated otherwise, a subscription is personal to the subscriber and cannot be transferred.

 

6. Billing and Automatic Renewal Subscriptions are billed on the recurring basis displayed at checkout and automatically renew until cancelled. By purchasing a recurring subscription, you authorise us or our payment provider to charge the applicable subscription fee to your nominated payment method at each renewal. You are responsible for keeping payment details current. If payment cannot be processed, access may be temporarily suspended while the payment issue is resolved.

 

7. Cancellation and Refunds You may cancel your subscription at any time using the cancellation method made available through your account or by contacting 2K Betting Premium. Unless otherwise stated at the time of purchase, cancellation takes effect at the end of the current paid billing period and access continues until that date. Refunds are not provided for change of mind or unused portions of a subscription period, except where required under the Australian Consumer Law or other applicable law. Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded.

 

8. Subscription Price Changes We may change subscription prices from time to time. Existing subscribers will be given reasonable advance notice of a price increase before it applies to a future renewal. If you do not agree with a new price, you may cancel before the new price takes effect. A price change will not retrospectively change an amount already paid for a completed billing period.

 

9. Delivery of Member Content Member content may be delivered through the 2K Betting Premium website, email, direct message, WhatsApp, Signal or another private member channel disclosed to you. Where a particular third-party messaging platform is a material method of delivering a plan inclusion, we will disclose that before purchase. Availability and operation of third-party platforms are outside our direct control.

 

10. WhatsApp, Signal and Member Messaging Privacy 2K Betting Premium may offer access to private messaging groups or channels through third-party services such as WhatsApp or Signal for the delivery of analysis, suggested selections, market information, alerts and member updates. Participation in a private messaging group involves the use of the relevant third-party platform. Depending on the platform, group type and your privacy settings, other participants may be able to see information associated with your account. This may include your profile name, profile photograph, username and/or telephone number. In some WhatsApp group configurations, your telephone number may be visible to other group participants. Before joining, you should review the platform privacy settings and decide whether you are comfortable with the information that may be visible to other participants. By actively choosing to join a 2K Betting Premium messaging group after receiving this disclosure, you acknowledge and consent to the visibility or disclosure of account information that is reasonably inherent in your participation in that selected platform and group configuration. This consent is limited to participation in the selected member channel. It does not authorise 2K Betting Premium to use your telephone number or other personal information for unrelated purposes. WhatsApp, Signal and other third-party messaging platforms operate independently and have their own terms, privacy settings and data-handling practices. 2K Betting Premium does not control those platform functions. This clause does not exclude any responsibility that the law requires 2K Betting Premium to retain.

 

11. Member Messaging Group Conduct To protect members, you must not misuse information obtained through a 2K Betting Premium messaging group or channel.

• Do not harvest, copy, compile, sell or distribute another member's telephone number, profile information or other personal information.

 

• Do not contact another member for unsolicited marketing, promotion, sales activity, harassment or other unauthorised purposes. • Do not publish, repost or distribute another member's personal information or private messages outside the group without permission.

 

• Do not use member information in a way that is unlawful, threatening, abusive, misleading or intended to cause harm.

 

• Comply with any reasonable group rules communicated by 2K Betting Premium. We may remove or suspend a member from a private channel where we reasonably believe the member has breached these rules, misused another participant's information, harassed another member or otherwise materially breached these Terms. Where appropriate, we may provide notice and an opportunity to respond. You may leave a messaging group at any time. Leaving a messaging group does not automatically cancel your underlying paid subscription; subscription cancellation must be completed separately under clause 7.

 

12. Messaging Opt-In and Withdrawal Where joining a WhatsApp, Signal or similar member group is optional, we will seek a separate affirmative opt-in and will not pre-tick that consent. If you choose not to join an optional messaging group, you will retain access to any other plan inclusions that do not depend on that channel. If a particular messaging channel is essential to a material plan inclusion, we will make that clear before purchase. You can withdraw from the messaging group by leaving the group. Withdrawal from the group does not affect the lawfulness of handling that occurred while you were participating and does not, by itself, cancel your paid subscription.

 

13. Service Communications and Marketing We may send communications reasonably necessary to administer your subscription, including payment, account, security, access and material service-update messages. Promotional or marketing communications will be sent only where permitted by applicable law and in accordance with any consent or communication preference you have provided. Where required, marketing messages will identify the sender and provide a functional way to unsubscribe. You may withdraw consent to marketing communications at any time. Opting out of marketing does not prevent us from sending non-promotional service messages that are reasonably necessary to administer your subscription.

 

14. Odds, Markets and Third-Party Information Odds, markets, team information, player availability, injuries, weather, starting line-ups and other sporting or third-party information may change after content is prepared or published. We do not guarantee that quoted odds, markets or third-party information will remain available, accurate or unchanged. References to a bookmaker, wagering provider, sporting body, league, team or third-party data source do not by themselves imply endorsement, sponsorship or affiliation.

 

15. Responsible Gambling 2K Betting Premium encourages responsible gambling. You should only wager amounts you can afford to lose, take breaks where appropriate and avoid chasing losses. If gambling is causing concern or harm, consider stopping and accessing an appropriate support service. Australian support options include Gambling Help Online and BetStop - the National Self-Exclusion Register for Australian licensed interactive wagering services. 2K Betting Premium is not a wagering provider and does not represent that it can determine whether a subscriber is registered with BetStop. If you are seeking to abstain from gambling, have self-excluded from wagering services, or believe access to wagering-related sports analysis may contribute to harm, you should not use the service or should cease using it.

 

16. Account Security and Sharing You are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account, except to the extent caused by our act or omission. Subscriptions and private member-channel access are for the individual subscriber unless we expressly agree otherwise. You must not share login credentials or private-channel access with another person.

 

17. Member Content and Intellectual Property Unless otherwise stated, content supplied through 2K Betting Premium - including analysis, selections, reports, graphics, commentary, messages and member-only information - is owned by or licensed to 2K Betting Premium and is provided for your personal, non-commercial use. You must not reproduce, republish, resell, systematically copy, scrape, distribute or commercially exploit member-only content without our prior permission, except where the law permits you to do so.

 

18. Service Availability and Changes We may reasonably change the format, features, delivery method or content of the service to improve it, address security or technical issues, respond to sporting-calendar changes, comply with legal or regulatory requirements, or reflect legitimate business needs. We will not knowingly make a change that materially deprives you of the core benefit of a paid subscription without providing an appropriate remedy where required by law. Planned material changes will be communicated where reasonably practicable.

 

19. Suspension and Termination We may suspend or terminate access where we reasonably believe you have materially breached these Terms, engaged in fraud or unlawful conduct, misused member information, shared paid content or account access without permission, or created a material security or safety risk. Where appropriate having regard to the seriousness of the issue, we may provide notice and an opportunity to remedy the breach before termination. Immediate action may be taken where reasonably necessary to protect members, the service or legal compliance. If we permanently discontinue a paid service for reasons unrelated to your breach, we will provide any refund, credit or other remedy required by the Australian Consumer Law or other applicable law.

 

20. Liability and Australian Consumer Law To the maximum extent permitted by law, 2K Betting Premium is not liable for wagering losses arising from a subscriber's independent decision to place a wager with a third-party wagering provider based on information supplied through the service. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or any other applicable law. Any limitation or exclusion in these Terms applies only to the extent permitted by law and must be read subject to those non excludable rights.

 

21. Privacy and Personal Information We will handle personal information in accordance with our Privacy Policy and applicable privacy laws. Our Privacy Policy explains the types of information we collect, why we collect it, how it is used and disclosed, how it is protected, and how you can contact us about privacy matters. If we use WhatsApp, Signal or another third-party member platform, our Privacy Policy will also disclose that the platform may process account and device information under its own privacy practices and that certain member details may be visible to other participants as described in clause 10.

 

22. Changes to These Terms We may amend these Terms where reasonably necessary, including to reflect changes to the service, applicable laws, regulatory requirements, security practices or legitimate business operations. Where a change is material, we will provide reasonable notice before it takes effect where practicable. If a material change adversely affects your ongoing subscription, you may cancel before the change takes effect. We will not rely solely on continued use to impose a material adverse change without reasonable notice where the law requires a different process. 

 

23. Governing Law 2K BETTING PREMIUM | MEMBERSHIP TERMS & CONDITIONS These Terms are governed by the applicable laws of Australia and, where relevant, the laws of ACT. Nothing in this clause restricts any mandatory consumer rights or remedies available to you in your State or Territory.

 

24. Severability If a provision of these Terms is found to be invalid, unlawful or unenforceable, it will be read down to the minimum extent necessary or, if that is not possible, severed. The remaining provisions will continue to operate.

 

25. Contact and Complaints Questions, subscription issues, privacy concerns or complaints may be directed to 2kbettingpremium@gmail.com. We will take reasonable steps to consider and respond to complaints. Nothing in this clause prevents you from exercising any external complaint or legal right available to you.
